Legal Child Custody

Unless circumstances recommend otherwise, courts prefer to award joint legal custody, which means that both parents share the right to make decisions about the children’s upbringing together and have equal access to their school and medical records.

Although the goal is to ensure that both parents have an equal say in how the children are raised, one parent usually receives the authority to make a final decision if they cannot agree on an important matter. This right normally goes to the parent with primary physical custody.

While shared legal custody is the ideal arrangement, the court will award sole legal custody to one parent if a former couple is too hostile to communicate effectively or there is evidence of child abuse or domestic violence.

Bill Gentry

William C. (“Bill”) Gentry has been practicing law in Georgia since 1986. His primary focus is divorce and family law cases, including high asset property division, child custody, and alimony cases. Bill was President of the 1,000-member Cobb County Bar Association from 2001 to 2002. Since 2012, Bill has been a member of the Board of Governors of the State Bar of Georgia, the group that regulates Georgia lawyers. Bill has tried hundreds of cases in state and federal courts throughout Georgia, and he has argued dozens of appeals in both state and federal appellate courts in Georgia. He is admitted to and has argued in the Georgia Supreme Court and the Georgia Court of Appeals and the 11th Circuit U.S. Court of Appeals in Atlanta. Bill is also a member of the bar of the United States Supreme Court. He has been a member of the Cobb County Bar Association since 1988, the State Bar of Georgia since 1986, the American Bar Association, and the Georgia Trial Lawyers Association. Bill is a Phi Beta Kappa graduate of the University of Virginia’s Economics Honors Program where he earned his BA degree in 1981. Bill earned his law degree from the University of Georgia in 1986. Bill has served as Lay Leader of Due West United Methodist Church and has previously served as Chair of its Administrative Board, its Long Range Planning Committee, and its Staff Parish Relations Committee. Bill currently chairs the District Union Committee of the Atlanta Marietta District of the North Georgia Conference of the United Methodist Church. Bill also serves on several other boards of charitable organizations.
